General provisions

  1. The following Privacy Policy describes the data protection issues related to the processing of data by Forge of Generals based on the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (“RODO”).
  2. The following Privacy Policy describes data protection issues related to the use of the forgeofgenerals.eu(“Store”) online store.
  3. This Privacy Policy is part of the Terms and Conditions of the Store (“Terms and Conditions”).

Personal information

  1. The administrator of your personal data is Data Legal Solutions sp. z o.o. with its registered office at 5/502 Obrzeżna St. in Warsaw (02-691), registered in the register of entrepreneurs kept by the District Court for the Capital City of Warsaw in Warsaw, XIII Commercial Department of the National Court Register under the number 0000722574, REGON: 369669450, NIP: 5213816567, Share capital PLN 5,000 fully paid up (hereinafter referred to as “FOG”).
  2. FOG may process personal data:
    1. in order to conclude a contract for the provision of services by electronic means and to conclude a contract of sale with a customer at a distance via an online store under the terms and conditions described in the Rules of the Forge of Generals online store (hereinafter referred to as the “Rules”) on the basis of Article 6(1)(b) of the RODO.
    2. in order to conclude a contract for the provision of Newsletter services under the terms of the Newsletter Regulations on the basis of Article 6(1)(b) of the RODO.
    3. for the purpose of exercising the withdrawal from the agreement concluded remotely on the basis of Article 27 of the Act of May 30, 2014 on consumer rights and for the purpose of exercising rights concerning warranty for defects of the sold thing on the basis of Article 560 of the Civil Code and Article 561 of the Civil Code on the basis of the implementation of the legal obligation incumbent on FOG (Article 6.1.c RODO).
    4. for contact purposes on the basis of FOG’s legitimate interest (Article 6(1)(f) RODO);
    5. for the purpose of entering into and performing contracts on the basis of FOG’s legitimate interest (Article 6.1.f of the DPA) or on the basis of actions necessary to enter into and perform the contract (Article 6.1.b of the DPA);
    6. for web analytics purposes and to improve the quality of use of the site, as well as for remarketing purposes on the basis of the consent given (Article 6(1)(a) of the RODO), in particular under the terms of the cookie policy;

Processing of personal data in order to perform the contract for the provision of services by electronic means under the terms described in the Regulations

  1. Personal data will be processed for the purpose of performing the contract for the provision of services by electronic means pursuant to Article 6(1)(b) of the DPA, in particular the establishment of an individualized user account and the sale of products under the terms of the Regulations.
  2. Provision of personal data is voluntary, however, failure to do so will prevent the provision of services.
  3. The transferred data will be processed for the period of limitation of claims arising from non-performance or improper performance of the contract for the provision of electronic services or related to the purchase of goods. This period will be calculated from the date of termination of this Agreement.

Processing of personal data for the performance of the Newsletter service

  1. Personal data will be processed for the purpose of executing the Newsletter service contract on the basis of Article 6(1)(b) of the RODO under the terms and conditions specified in the portal’s regulations (https://forgeofgenerals.eu/wp-content/uploads/2021/06/Regulamin-newslettera-FOG.pdf).
  2. Provision of personal data is voluntary, however, failure to do so will prevent the provision of services.
  3. The transferred data will be processed for the period of the statute of limitations for claims arising from non-performance or improper performance of this Agreement. This period will be calculated from the date of termination of this Agreement.
  4. Provision by the user of an identifying e-mail address will be considered an order for commercial information in accordance with Article 10(2) of the Law on Provision of Electronic Services.
  5. The data processed for this purpose is disclosed to The Rocket Science Group LLC d/b/a MailChimp, which uses technical infrastructure located in the US and with whom DLS has entered into Standard Contractual Clauses (SCC) to ensure an adequate level of personal data protection as required by European regulations;
  6. Individuals whose data is processed for the above purpose have the following rights related to the processing of personal data:
  7. The right to access and correct personal data; the user can exercise the right to access and correct their data by using the appropriate button located in the footer of the email sent or by sending a message to shop@forgeofgenerals.eu
  8. The right to request deletion of personal data;
  9. The right to request restrictions on the processing of personal data;
  10. The right to portability of personal data, i.e. the right to receive personal data from Data Legal Solutions in a structured, commonly used machine-readable computer format. You may send this data to another data controller. The right to data portability applies only to personal data that you have provided and we are processing on the basis of a contract with the data subject or on the basis of the data subject’s consent;
  11. The right to lodge a complaint with an authority – the data subject also has the right to lodge a complaint with the supervisory authority dealing with personal data protection, i.e. the President of the Office for Personal Data Protection.

Processing of personal data for the purpose of withdrawal from the contract concluded at a distance and the exercise of rights concerning the warranty for defects of the sold thing.

  1. The personal data provided will be processed for the purpose of exercising rights related to the warranty for defects of the thing sold on the basis of Article 560 of the Civil Code and Article 561 of the Civil Code in connection with Article 6(1)(c) of the RODO. The data will be processed for the period of limitation of claims resulting from non-performance or improper performance, i.e. 6 years. This period will be counted from the date of realization of the reclamation.
  2. Personal data will be processed for the purpose of withdrawing from a contract concluded remotely on the basis of Article 27 of the Act of May 30, 2014 on Consumer Rights in conjunction with Article 6(1)(c) of the RODO. The data will be processed for the period of limitation of claims related to the non-exercise or improper exercise of the right to withdraw from the contract. This period will be calculated from the date of exercise of the right of withdrawal.

Processing of personal data for contact purposes

  1. Provision of data for the purposes of contacting and responding to a question, including the presentation of an offer, is voluntary, but failure to do so will prevent sending a response to the question.
  2. The data you provide for this purpose will not be shared with other parties, but may be disclosed to companies that provide us with data hosting services.
  3. The data provided for this purpose will be processed for a period of one year after the question is asked.

Processing personal data for web analytics and marketing/remarketing based on web identifiers

 

  1. The details of data processing for these purposes are specified in the cookie policy.
  2. Provision of personal data is voluntary.
  1. We use Google Ads marketing tools provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Google Ads is used to promote our website in search results and on third-party sites, including using remarketing tools. Activities in this regard are based on your consent to the use of your cookies under the terms described in the cookie policy. The functionality of Google Ads is based on leaving a Google cookie on your terminal device, which, by means of an identifier (ID) associated with the pages you visit, enables interest-based ads to be displayed. In addition, FOG uses Google Analytics, a tool for creating statistics, analyzing them and optimizing the website, provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. The tool collects data using cookies. Cookies may be used by advertising networks, in particular the Google network, to display ads tailored to the way you use the Website. For this purpose, they may retain information about the user’s navigation path or how long the user stayed on a particular page. The administrator of the data collected in this way is Google LLC. To learn about the third-party administrator’s use of cookies, please refer to Google’s privacy policies.
  1. The transferred data will be processed:
    1. For analytics purposes for 18 months from the date of your last visit to forgeofgenerals.eu;
    2. For marketing and remarketing purposes for a period of 1 month after your last visit to the Store.

Your rights in relation to the processing of personal data

  1. Individuals whose data is processed for the above purposes have the following rights related to the processing of personal data:
    1. The right to withdraw the consent given, when the basis for processing is the consent given;
    2. The right of access to personal data;
    3. The right to request rectification of personal data;
    4. The right to request deletion of personal data;
    5. The right to request restrictions on the processing of personal data;
    6. The right to portability of personal data, when the basis of processing is the consent given or the contract concluded, and the processing of personal data is carried out by automated means;
    7. The right to object to the processing of data when the basis for our processing of such data is FOG’s legitimate interest.
    8. The right to lodge a complaint with an authority – the data subject also has the right to lodge a complaint with the supervisory authority dealing with personal data protection, i.e. the President of the Office for Personal Data Protection.

 

  1. In the case of data processing for web analytics and marketing/remarketing based on web identifiers, rights from b-g may be exercised by data subjects under the terms of Google LLC (Google privacy policy) and Facebook (Facebook privacy policy)

  1. The data will not be disclosed to other entities except those authorized to do so by law and only upon their legitimate request. However, the data may be disclosed to IT support companies and hosting companies within the scope of services performed for FOG, as well as postal operators and courier companies within the scope of delivery or collection of the order.
